YouTube copyright takedowns: when to file and when not to

Copyright removal requests are often the fastest way to take down a copy of your video, music or footage. They are also legal statements, which is why it pays to understand them before you file.

Who can file

Only the copyright owner, or someone authorised to act for them, can request a removal on copyright grounds. You are usually the owner if you created the work yourself. If someone else filmed or produced it for you, ownership depends on your agreement with them.

What qualifies

  • Full re-uploads of your videos
  • Compilations or edits built mainly from your footage
  • Your music, photos or artwork used without a licence

When not to file

Copyright law allows certain uses without permission, often called fair use or fair dealing depending on the country. Commentary, criticism, news reporting and parody can fall into this category, especially when only short extracts are used. A takedown aimed at criticism you dislike is likely to be challenged, and filing a knowingly false claim can carry legal liability.

If the real problem is that a video says false things about you, the copyright route is the wrong tool. Read about defamation and harassment requests instead.

What happens after you file

YouTube reviews the request and, if it is complete and valid, removes the video. The uploader’s channel may receive a copyright strike. The uploader also receives the claimant’s contact details, because the law requires it, and can send a counter notification if they believe the removal was a mistake. If they do, the video may be restored after a waiting period unless the claimant starts legal action.

Tips for a successful request

  • Identify the original work clearly, with a link and publication date
  • Specify which parts of the infringing video use your content
  • Make sure the details you provide are accurate and complete

Our copyright takedown service checks ownership and fair use questions first, then prepares and files the notice for you.
